Terms of service

BAGATTEST ("BAGATTEST", "we", "us") provides an independent, photograph-based authentication service for designer handbags. These terms form a binding agreement between you and BAGATTEST.

They apply to the website at bagattest.com, to our mobile application once it is released (together, "the service"), and to every authentication report we produce. If you do not agree with these terms, please do not use the service.

You must be at least 18 years old, or the age of majority where you live, to create an account or buy a package. By using the service you confirm that you can enter into a binding contract with us.

If you use the mobile app, the terms of the app store you downloaded it from also apply. Where those store terms conflict with these terms, these terms apply to the extent permitted by law.

You need an account to start an authentication and to keep your reports. You agree to give accurate details, to keep your password and email verification codes confidential, and to tell us promptly if you believe someone else has accessed your account.

You are responsible for activity carried out through your account. We may suspend or close an account that is used to break these terms, to harm other people, or to interfere with the service.

You send us photographs of a handbag, and we produce a written report containing a verdict, a confidence figure, a six-point scorecard and findings in plain language.

A report is an informed opinion based only on the photographs you supply. It is not a certificate, an appraisal, a valuation, or a legal guarantee of authenticity, and it does not replace an in-person inspection by a qualified specialist. Photographs can hide or misrepresent details, and our opinion is limited to what is visible in them.

Reports are produced with the help of automated analysis and are reviewed according to the process described on the website at the time of your order. We may update that process as the service develops.

You keep ownership of the photographs and information you upload. You give us permission to store, process and analyse them for the purpose of producing your report and keeping it in your account.

You confirm that you have the right to send us the photographs, that they show an item you lawfully possess or are authorised to submit, and that they do not contain unlawful material or other people’s private information that you are not allowed to share.

Photographs and reports are stored privately in your account. You can delete an authentication at any time, which removes its photographs and its report. Deleting content also removes it from your archive, so print or save anything you want to keep first.

Authentications are sold in prepaid packages: one authentication for $8, three for $20, five for $30, and ten for $50. Prices are in US dollars and may change for future purchases. The price shown at checkout is the price that applies to your order.

Payment is handled by a third-party payment provider. We do not receive or store your full card details. Your package becomes available in your account once the payment is confirmed.

Prepaid authentications stay in your account until you use them. They are personal to your account and cannot be transferred, resold or exchanged for cash.

Unused authentications can be refunded on request within 30 days of purchase. Write to us from the email address on your account and we will return the unused balance to your original payment method.

Once an authentication has been started and a report has been produced, it cannot be refunded, because the digital report has already been delivered to you.

If a report cannot be produced because of a technical failure on our side, we will restore the authentication to your account or refund it, at your choice.

You agree not to use the service to mislead anyone about an item. In particular, you must not use a BAGATTEST report to present a counterfeit, altered or different item as authentic, and you must not edit, crop or reformat a report in a way that changes its meaning.

You also agree not to copy, scrape or resell the service; not to attempt to access accounts, data or systems that are not yours; not to interfere with the operation or security of the service; and not to use automated tools to submit authentications in bulk.

Your report is for your own use. You may print it, save it as a PDF, and share it in full with a buyer, a seller or a marketplace when you are discussing that specific item.

You may not present a report as an official certificate, use our name or marks in a way that suggests an endorsement of your business, or use reports as part of a competing authentication service.

The mobile app offers the same service as the website. It may ask for permission to use your camera or photo library so that you can submit photographs; it only accesses the images you choose.

Purchases made inside the mobile app may be processed by the app store rather than by our payment provider, in which case the store’s payment and refund rules also apply to that purchase. App store operators are not parties to these terms and have no responsibility for the service.

We rely on service providers for hosting, file storage, email delivery, payment processing and automated image analysis. They process data on our instructions and only for the purposes described in our privacy policy.

Links to other websites, marketplaces or app stores are provided for convenience. We are not responsible for their content or their practices.

The service, including our name, logo, website, app, report template and written content, belongs to us or our licensors and is protected by intellectual property laws. These terms give you a personal, non-exclusive, non-transferable right to use the service.

You may not copy, modify, distribute or create derivative works from our content without our written permission, except for the report you paid for and the limited sharing described above.

We work to keep the service available, but we do not promise uninterrupted access. Maintenance, provider outages and events outside our control may interrupt it, and we may change, add or withdraw features.

We may also update these terms. When we do, we will change the date at the top of this page and, for material changes, tell you by email or in the app before they take effect. Continuing to use the service after a change means you accept the updated terms.

The service is provided on an "as is" and "as available" basis. To the extent permitted by law, we exclude all implied warranties, including fitness for a particular purpose, and we do not warrant that a report will be free of errors or that it will be accepted by a buyer, a seller, a marketplace or an authority.

Nothing in these terms limits rights you have under mandatory consumer law where you live.

To the extent permitted by law, we are not liable for indirect, incidental or consequential losses, for lost profits, for loss of reputation, or for losses arising from a decision you or someone else makes about an item based on a report.

Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. This does not limit liability that cannot be limited by law, including liability for fraud.

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms, from content you upload, or from your misuse of a report.

You may stop using the service at any time and may ask us to close your account. We may suspend or end your access if you break these terms, if we are required to by law, or if continuing would expose other users or us to risk.

If we close your account for a reason other than your breach, we will refund unused authentications. Sections on content, intellectual property, disclaimers, liability and governing law survive termination.

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

You and BAGATTEST agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute that cannot be resolved informally. Before filing a claim, please contact us so we can try to resolve the issue.

If you are a consumer living elsewhere, this section does not deprive you of the protection of mandatory rules in your country of residence, or of the right to bring proceedings in your local courts where the law gives you that right.

If a provision of these terms is found to be unenforceable, the remaining provisions stay in force. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms without our consent, and we may transfer ours as part of a merger, acquisition or sale of assets.

These terms, together with our privacy policy, are the entire agreement between you and BAGATTEST about the service.
